Eligibility Requirements
To file I-485 through marriage:
• Marriage must be legally valid and officially registered
• Petitioner spouse must be US citizen or LPR
• Marriage must be bona fide (real), not fraudulent
• Immigrant must have lawful entry to USA
• For LPR spouses (F2A) — current priority date per Visa Bulletin required
• For US citizen spouses (IR-1/CR-1) — no waiting, concurrent filing possible
Important: Marriage less than 2 years old at approval gives conditional green card (CR-1) for 2 years. File I-751 90 days before expiration. Set a reminder 4 months early!
Concurrent Filing: I-130 + I-485 Together
If your spouse is a US citizen, you can file I-130 (petition) and I-485 (green card application) simultaneously. This saves months of waiting.

• Photos, travel evidence of shared life
