Overstay Forgiveness: Marriage to a U.S. Citizen
One of the most common paths to legal status for those who have overstayed is marriage to a U.S. citizen. Here is how overstay forgiveness works.
Immediate relatives of U.S. citizens (spouses, unmarried children under 21, and parents) are NOT subject to the 3-year and 10-year bars for unlawful presence when adjusting status within the United States. This means you can file I-485 even if you have overstayed your visa.
Understanding the 3/10 Year Bars
The 3-year and 10-year bars apply when you depart the U.S. after accruing unlawful presence:
- 3-Year Bar:Triggered if you depart after 180+ days but less than 1 year of unlawful presence
- 10-Year Bar:Triggered if you depart after 1 year or more of unlawful presence
Key Point: These bars only apply if you DEPART the U.S. If you adjust status within the U.S. as an immediate relative, you do not trigger these bars.
Who Qualifies for Overstay Forgiveness
- Spouses of U.S. Citizens - Can adjust status despite overstay
- Unmarried Children Under 21 of U.S. Citizens
- Parents of U.S. Citizens (if citizen is 21+)
- • Spouses and children of permanent residents
- • Married children of U.S. citizens
- • Siblings of U.S. citizens
These categories are subject to the 3/10 year bars. May need a waiver (I-601) or may need to consular process with a waiver.
Adjustment vs. Consular Processing
Adjustment of Status (Recommended)
- • File I-485 while in the U.S.
- • Do not trigger 3/10 year bars
- • Can get work and travel permits during processing
- • Interview at local USCIS office
Consular Processing (Risky)
- • Leave U.S. for visa interview
- • May trigger 3/10 year bars
- • May need I-601 waiver (hardship to U.S. citizen spouse)
- • Risk of being stuck outside U.S.
- • If you entered without inspection (EWI) - different rules apply
- • If you have any criminal history
- • If you have previously been deported or removed
- • If you have a fake marriage
- • If you claimed to be a U.S. citizen on I-9 or other documents
