Concurrent Filing: I-130 and I-485 Together

What is Concurrent Filing?

Concurrent filing means submitting Form I-130 and Form I-485 at the same time (or I-140 and I-485 for employment-based). This is only allowed when a visa number is immediately available for your category.

Who CAN File Concurrently

Eligible Categories
  • Immediate relatives of U.S. citizens (spouses, unmarried children under 21, parents)
  • Some employment-based categories where visa numbers are current
  • Certain special categories (asylees, refugees after 1 year)

Who CANNOT File Concurrently

Must Wait for Visa Availability
  • Family preference categories (married children, siblings, married sons/daughters) - visa backlogs
  • Employment-based categories with visa backlogs
  • Diversity visa lottery winners (file separately)

These categories must wait for a visa number to become available based on the monthly Visa Bulletin before filing I-485.

  • Form I-130 - Petition for Alien Relative (filed by U.S. citizen/permanent resident)
  • Form I-130A - Supplemental Information for Spouse Beneficiary (if applicable)
  • Form I-485 - Application to Register Permanent Residence
  • Form I-864 - Affidavit of Support (financial sponsorship)
  • Form I-765 - Application for Employment Authorization (optional but recommended)
  • Form I-131 - Application for Travel Document (optional but recommended)
  • Form G-1145 - E-Notification of Application/Petition Acceptance (optional)
