Concurrent Filing: I-130 and I-485 Together

What is Concurrent Filing?
Concurrent filing means submitting Form I-130 and Form I-485 at the same time (or I-140 and I-485 for employment-based). This is only allowed when a visa number is immediately available for your category.

Who CAN File Concurrently
Eligible Categories
- Immediate relatives of U.S. citizens (spouses, unmarried children under 21, parents)
- Some employment-based categories where visa numbers are current
- Certain special categories (asylees, refugees after 1 year)
Who CANNOT File Concurrently
Must Wait for Visa Availability
- Family preference categories (married children, siblings, married sons/daughters) - visa backlogs
- Employment-based categories with visa backlogs
- Diversity visa lottery winners (file separately)
These categories must wait for a visa number to become available based on the monthly Visa Bulletin before filing I-485.

- Form I-485 - Application to Register Permanent Residence

- Form I-765 - Application for Employment Authorization (optional but recommended)
- Form I-131 - Application for Travel Document (optional but recommended)
- Form G-1145 - E-Notification of Application/Petition Acceptance (optional)
